⚠️ ABSOLUTE USER LIABILITY DISCLAIMER: By accessing, registering, or utilizing Picviva Pro, you explicitly acknowledge and agree that 100% legal, financial, and operational responsibility rests solely upon you (the user). The platform owners, administrators, and developers assume zero liability for any data loss, copyright breaches, financial disputes, or regulatory violations.

1. Absolute User Responsibility & Indemnification

The user agrees to defend, indemnify, and hold harmless the platform operators, creators, and affiliates from any claims, damages, obligations, losses, liabilities, or expenses arising from:

Your use of and access to the Picviva Pro canvas and export utilities.
Your violation of any term of these Terms of Service or applicable laws.
Your infringement of any third-party right, including without limitation any copyright, trademark, privacy, or proprietary property right.

2. Digital Personal Data Protection (DPDP) Guidelines Compliance

In compliance with modern data protection standards (including the Digital Personal Data Protection Act):

Sole Data Fiduciary/Processor: The user acts as the independent controller and processor of any personal imagery, photographs, or textual data uploaded onto the software interface.
Consent Management: You warrant that you have obtained explicit, verifiable consent from all individuals whose images, likenesses, or private data are processed, edited, or exported through this tool.
Platform Exemption: The platform does not store, curate, analyze, or commercialize user-uploaded photographs or personal information. Consequently, all liabilities concerning data privacy breaches rest entirely with the user.

3. Copyright & Intellectual Property Waiver

Users bear complete responsibility for verifying that all graphics, stickers, photos, and fonts utilized in their layouts comply with intellectual property laws. Uploading unauthorized copyrighted material is strictly at the user's own legal risk.

4. Subscription, Payments & Third-Party Transfers

All subscription payments made via QR code scanning or manual transfers are verified manually. The platform owners bear no liability for erroneous transactions, third-party gateway failures, or incorrect recipient transfers made by the user.
